債權已經償還一部分申請本票裁定是否會被駁回?不會!
假設本票金額200萬
104/01/01發票
104/03/11為到期日
對方僅支付20萬外,之後金額皆未償還

聲請書狀如下

請准裁定將相對人於民國104年1月1日簽發、到期日為104年3月11日，內載憑票交付金額新台幣2,000,000元整之本票乙紙，就其中1,800,000元及自104年3月11日起至清償日止按年息6％計算之利息予以強制執行。
