拍電影拿不到錢 導演獲賠確定

導演潘志遠指控禾田電影公司未依約給付拍電影的第二期款項60萬元。高等法院日前駁回上訴，仍判禾田敗訴，須付60萬元確定。

判決指出，導演潘志遠於民國101年間與禾田電影公司合作，計畫籌拍電影「我愛黑手（暫定名）」，雙方簽約明定片酬為新台幣300萬元，合作期間為101年10月至102年10月。

潘志遠指控，他收到第一期款項30萬元後，即開始選角、勘景，並將企劃案送台中市政府及金門縣政府審核，但禾田公司卻未依約在102年3月支付第二期款項60萬元。

法院審理期間，禾田公司主張，雙方是約定潘志遠要在102年春節前完成劇本，讓劇組開拍才會付第二期款，對方沒如期交出合用劇本，所以沒付錢。

一審法官審理認為，禾田公司無法證明雙方曾經約定完成劇本才付款，判禾田敗訴，須支付60萬元。

全案經上訴，台灣高等法院日前駁回上訴，維持一審見解，仍判禾田敗訴。全案確定。
