民進黨團修法　監聽機關改隸高等法院

【黃揚明／台北報導】民進黨團今提杜絕非法監聽相關修法內容，民進黨立委吳宜臻指出，此次修法最大制度改變，就是將監聽建置機關不再留在調查局和警政署，改由台灣高等法院設置，未來修法後，把監聽機房、設備移至高等法院，並將調查局的通訊監察處、警政署的通訊監察中心予以刪除，讓監聽建置機關能維持中立。

民進黨團幹事長高志鵬說，《刑事訴訟法》修法牽涉兩部分，一個是設立監聽等強制處分的審查專庭，負責核發監聽票的法官與該案審判法官不得相同，以專庭、專人方式求取核發監聽票標準一致，事後權責分明。此外，因現行刑事訴訟制度沒把監聽列入準抗告範圍，因此修法保障被監聽者的救濟權，若不服監聽處分可提抗告，讓法院確認違法的監聽喪失證據能力。
